Volunteer Waiver and Media Release

This Volunteer Waiver and Media Release (“Agreement”) is entered into by the undersigned Volunteer (“Volunteer”) and the Project MORE Foundation Inc., doing business as Qmunity, including Qmunity District (collectively referred to as “Qmunity”), for volunteer services provided across all Qmunity programs and activities.

Qmunity is a 501(c)(3) nonprofit committed to advancing community through cultural programming, wellness education, safer spaces, and self-expression. Your willingness to volunteer directly supports and uplifts 2SLGBTQIA+ communities across California and beyond.

1. Definitions

  • Volunteer: Any individual providing unpaid services for Qmunity programs or activities.
  • Organization: Project MORE Foundation Inc., doing business as Qmunity, including Qmunity District and all affiliated entities.
  • Activities: Any and all volunteer duties, services, programs, events, or activities organized, sponsored, or supported by Qmunity.
  • Media: Photographs, video, audio, written or digital materials, and any other form of media that depicts or includes the Volunteer.

2. Consent to Volunteer Service

I voluntarily apply and agree to participate in Qmunity’s programs and activities as a Volunteer. I certify that I have the legal capacity to consent to the terms outlined in this Agreement on my own behalf and, if applicable, on behalf of any individuals for whom I am legally authorized to provide consent. I acknowledge that I am participating as a Volunteer and not as an employee, agent, or contractor of Qmunity.

3. Assumption of Risk, Release, and Waiver of Liability

I understand and accept that volunteering may involve certain risks, including but not limited to unforeseen events, known or unknown hazards, adverse weather conditions, or the actions of others. I voluntarily assume all such risks associated with my participation. I release and hold harmless Qmunity—along with its affiliates, directors, officers, staff, agents, contractors, volunteers, sponsors, donors, and partners—from any claims, liabilities, or damages arising from my volunteer activities, to the fullest extent permitted by law.

4. Medical Treatment Consent

I authorize Qmunity to provide or obtain emergency medical care as necessary during my volunteer service. I understand that I am solely responsible for any medical expenses incurred. I acknowledge that Qmunity does not provide, and is not responsible for providing, financial or other assistance, including but not limited to health, medical, disability, or life insurance benefits in the event of injury, illness, or death. I release Qmunity from any liability, to the extent permitted by law, for costs or consequences arising from the provision, delay, or lack of medical care, including those resulting from the negligence of Qmunity or its representatives, except where prohibited by law.

5. Confidentiality

I agree to maintain confidentiality regarding any sensitive or private information I may encounter while volunteering and to actively foster a safe, respectful, and affirming environment for all community members, staff, and participants.

6. Media Release

I grant Qmunity full rights to use my image, likeness, voice, and statements recorded during volunteer activities in any media format. This includes, but is not limited to, use for archival, promotional, educational, fundraising, and storytelling purposes across websites, social media, reports, and grant documentation. I understand that I will not receive any compensation for this use and waive any right to review or approve the materials produced.

7. Communication

I authorize Qmunity to contact me regarding volunteer opportunities, scheduling, organizational updates, and community events through email, telephone, text message (SMS), and postal mail. I understand that my contact information will be used solely for these purposes and will be handled in compliance with applicable U.S. and California privacy laws, including the California Consumer Privacy Act (CCPA) and its amendments.

I acknowledge that I may opt out of non-essential communications or withdraw my consent at any time by contacting Qmunity or following the opt-out instructions provided in communications. For more information on how my data is collected, used, and protected, I may review Qmunity’s Privacy Policy.

By signing this Agreement, I give express consent to receive communications via SMS, telephone, and email, in compliance with the Telephone Consumer Protection Act (TCPA).

8. Parent/Guardian Consent (For Volunteers Under 18)

I am the parent or legal guardian of the minor Volunteer named in this Agreement. I have read and understand the terms of this Agreement, consent to my child’s participation in volunteer activities, and agree to all terms and conditions on their behalf.

9. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in the County of Santa Clara, California, United States of America.
